OF COMMITTING A CRIME...NOW WHAT?

Being accused of committing a crime is one of the most gut wrenching experiences a human being can encounter. The feeling of uncertainty for yourself, your family, your job, your status in the community and your future is hard to cope with.

Getting answers to your questions is the best way to put your mind at ease. The facts of each case are different, and require different tactics. While cases usually move through the justice system similarly, each requires specific attention to ensure it is handled properly. To know you are getting the best information, it is important to contact a seasoned criminal defense attorney IMMEDIATELY to be sure you don't make things worse by divulging too much information to law enforcement by submitting to tests or questions. The first and most important information that everyone needs to know is you should never speak to the police after they arrest you without your attorney present.

Remember, police officers are not your friends. They may seem like nice people when they interrogate you. However, they have a job to do. When  you are detained and questioned by police, their job is to get you to admit to everything they can. You need to know what the police can do to you under the law. Police are allowed to lie to you during an interrogation. Police are allowed to interrogate you for hours on end. Police are allowed to keep you in an uncomfortable interrogation room overnight. They will attempt all of this and more unless you clearly state, "I would like to talk to an attorney."

 

It is important to be clear that you are asking for an attorney NOW. Asking an officer, "Should I talk to a lawyer?" or "Do you think I need a lawyer?" is NOT enough. If you ask those questions, the interrogation will continue. Remember, when placing you under arrest, police must advise you of your rights. They must say, "You have the right to remain silent. Anything you say can be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, one will be provided for you." DO NOT WAIVE ANY OF YOUR RIGHTS. If you are arrested, the only words you should say are, "Please let me talk to my lawyer." Then, call Matuszak Law and we will be there to help.
